Columbus, Ohio (August 2011) — Axelrod Laliberte partner Brian Laliberte announces a significant victory for a national brokerage firm sued in the Common Pleas Court of Lucas County, Ohio. Laliberte’s client was sued by a third-party beneficiary of retirement accounts that the brokerage firm managed for a customer.
The Lucas County Common Pleas Court agreed with Laliberte's argument that third-party beneficiaries must arbitrate claims arising from retirement accounts held or managed by broker-dealers before the Financial Industry Regulatory Authority (FINRA) pursuant to customer account agreements. As a result, the court stayed all proceedings before it in favor of arbitration.
